Welcome to Atlanta Tour Express! Please read these Terms and Conditions (T&C) carefully. By booking or participating in any tour, educational program, or transportation/shuttle service (collectively, the "Participation"), you agree to these T&C.

1. Acceptance and Agreement

By proceeding with the Participation, the Participant (you) confirms the following:

• You are of legal age and possess the competence to enter into this agreement.

• You agree to be legally bound by all terms set forth below.

• If signing for a minor, you are the parent or legal guardian and accept these terms on their behalf.

 

2. Assumption of Risk

The Participant acknowledges and agrees that all Participation involves inherent risks and hazards, which may result in property damage, severe bodily injury, or death, even when reasonable safety measures are taken.

• Voluntary Assumption: You voluntarily assume all risks, known and unknown, associated with the Participation.

• Examples of Risks (Including but not limited to):

  • Vehicular accidents and collisions.

  • Injuries resulting from extending body parts outside the vehicle.

  • Hazards from road debris, uneven terrain, or construction.

  • Environmental hazards (e.g., severe weather, insect bites).

 

3. Release and Waiver of Liability

In consideration of being permitted to participate, the Participant hereby irrevocably releases and waives all present and future claims, demands, and causes of action against Atlanta Tour Express, LLC and its members, officers, agents, employees, independent contractors, and representatives (collectively, the "Released Parties").

• This waiver applies to any loss, property damage, bodily injury, or death arising out of or connected with the Participation.

 

4. Indemnification and Hold Harmless

The Participant agrees not to initiate (or permit to be initiated) any legal action against the Released Parties concerning any loss, injury, or damage related to the Participation.

• Indemnification: The Participant agrees to indemnify and hold harmless the Released Parties from any and all claims, demands, expenses, or causes of action asserted against them resulting from the Participation.

• Legal Costs: The Participant shall bear the full financial expense of the Released Parties in defending any legal action or claim brought by or on behalf of the Participant.

 

5. Participant Conduct and Rules

The Participant must strictly comply with all rules, regulations, and instructions provided by Atlanta Tour Express staff during the entire duration of the service.

• Non-Compliance: Failure to comply with safety instructions may result in immediate termination of the Participation without refund.

 

6. Media Release (Photo and Video)

The Participant grants Atlanta Tour Express permission to capture photographs or video during the tour for use in marketing, social media, and company publications.

• Opt-Out Clause: If you do not wish to be photographed or filmed, you must explicitly notify Atlanta Tour Express staff prior to the start of the service.

 

7. Sales Policy (Finality of Sale)

ALL SALES ARE FINAL. The Participant understands and agrees that all fees, payments, and charges associated with the booking of the Participation are non-refundable and non-reimbursable, regardless of the reason for cancellation, non-attendance, or termination of the tour (including termination under Section 5).
